Terms of Service

These Terms of Service ("Terms") are a contract between you and Caelori LLC ("Caelori," "HauntKeep," "we," "our," or "us") and govern your use of the HauntKeep app and website (the "Service"). By using the Service you agree to these Terms. If you do not agree, do not use the Service. Contact: hello@hauntkeep.com.

Entertainment only — the most important term

HauntKeep is an entertainment app. It is not a scientific, medical, or safety instrument, and it does not detect ghosts, spirits, or any supernatural phenomenon. Its instruments read ordinary phone sensors — a magnetometer, an accelerometer, a microphone, a camera — and display or interpret those readings for entertainment. Nothing the app outputs is evidence of a presence of any kind, and nothing in the Service should be understood as a claim that such a presence exists or has been detected.

Modes labeled EXPERIENCE are interpretive by design: they turn a real sensor reading into words, sounds, motion, or imagery for atmosphere. An output from such a mode is a product of the app's rules, not a message from anyone or anything.

Eligibility

You must be old enough to form a binding contract in your jurisdiction to use the Service. HauntKeep contains paranormal and mild-horror themes, is intended for a general audience, and is not designed for young children.

Use of the Service

You may use HauntKeep to run your own investigations and create your own recordings, captures, and sessions. You agree not to misuse the Service, interfere with its operation, attempt to access it by unauthorised means, reverse engineer it except as permitted by law, or use it unlawfully or to infringe others' rights.

Personal safety and lawful investigation

You are solely responsible for where you go and what you do while using HauntKeep. Investigating often means unfamiliar places, darkness, and private property. You agree to obey all applicable laws — including trespass, curfew, recording-consent, and privacy laws — to obtain permission before entering or recording on property that is not yours, and not to enter any location that is unsafe, condemned, or restricted.

The Service is not designed for emergencies and must not be relied upon where personal safety, structural safety, gas or electrical hazards, medical needs, law-enforcement activity, or public-safety decisions are involved. Do not treat any HauntKeep reading as a safety measurement.

Recording other people

HauntKeep can record audio and capture images. Laws governing the recording of people vary by jurisdiction and can require the consent of everyone recorded. You are responsible for obtaining any consent required where you are, and for how you use or publish anything you capture.

No accounts

HauntKeep does not require or create a user account, and we operate no servers of our own.

Your content

Recordings, captures, notes, and sessions you create ("Your Content") remain yours, and they stay in the app's private storage on your device. We do not host, receive, store, or have access to Your Content, so we grant ourselves no licence to it. Because Your Content lives only on your device, you are responsible for your own copies: uninstalling the app deletes all of it, and we cannot recover it for you. See the Privacy Policy for what the app does and does not transmit.

Sharing and responsible use of output

You are solely responsible for any recordings, captures, reports, exports, screenshots, social-media posts, publications, or other materials you create, publish, or distribute using the Service. You agree not to present HauntKeep output as scientific evidence, an official finding, an expert determination, or proof of a supernatural presence, or to alter it in a way that misrepresents what the app actually measured.

Nature of the output — no warranty of accuracy

HauntKeep's readings depend on the sensors in your particular device, their calibration, and the environment around you, and they may be incomplete, noisy, or wrong. Consumer phone sensors are not laboratory instruments. Environmental context (weather, sun times, moon phase, and the space-weather Kp index) is fetched from third-party services, is labeled as fetched rather than measured, and may be unavailable or inaccurate. We do not guarantee the accuracy, completeness, or availability of any reading, analysis, session report, or third-party data.

Third-party services and content

Some features contact third-party services — Open-Meteo, the NOAA Space Weather Prediction Center, and radio-browser.info — as described in the Privacy Policy. Radio Sweep tunes across public internet radio streams for ambience only; we do not select, control, endorse, or take responsibility for the audio those third-party stations broadcast, and the sweep is not a detection of anything.

Intellectual property

The Service, including its software, design, content we provide, and the HauntKeep name and logos, is owned by Caelori LLC or its licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Service for its intended purpose. No rights are granted except as expressly stated.

Price and distribution

HauntKeep is distributed through Google Play and is subject to that store's terms in addition to these. If paid features are offered in future, they will be sold and billed through your store account, and refunds handled under the applicable app-store policy.

Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, Caelori LLC and its operators will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any decisions made or actions taken in reliance on the Service's output.

To the fullest extent permitted by law, the aggregate liability of Caelori LLC arising out of or relating to the Service shall not exceed the greater of (a) one hundred U.S. dollars (USD $100) or (b) the total amount you paid for the Service during the twelve months preceding the event giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Caelori LLC from claims arising out of your misuse of the Service or violation of these Terms or applicable law, to the extent permitted by law.

Force majeure

Caelori LLC shall not be liable for any failure or delay resulting from causes beyond its reasonable control, including failures of telecommunications systems, cloud providers, third-party data sources, weather-data providers, governmental restrictions, natural disasters, labor disputes, or internet outages.

Export compliance

You may not use the Service if prohibited by applicable export-control laws, sanctions programs, or trade restrictions. You represent that you are not located in, under the control of, or a resident of any jurisdiction subject to comprehensive sanctions.

Changes & termination

We may update the Service or these Terms; continued use after changes constitutes acceptance. We may suspend or terminate access for misuse or to comply with law.

Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict-of-laws rules, except where applicable consumer-protection law provides otherwise.
